York County And Fort Mill School District Go To Court Over Disagreement On How To Spend Funds

YORK CO., S.C. — York County and the Fort Mill School District are going to court over a disagreement on how to spend the Fort Mill School District Impact Fees.

Both districts have differing legal opinions related to the use of impact fees collected under the South Carolina Development Impact Fee Act, and for this reason, they are seeking direction from the court.

Officials say this action is being taken in order to best determine the use of funds collected by York County since the creation of the Fort Mill School District impact fee in 2018.

These funds are currently being held in trust with the York County Finance Department, according to a news release.

Officials say in an effort to protect the interests of taxpayers, all parties have agreed that this is the best course of action to pursue.
